EXPERTISE & EXPERIENCE:
Partner, Adam Hopkinson leads a prosecution and enforcement group that regularly represents local authorities, including Bay of Plenty Regional Council, Tauranga City Council, Whakatane District Council and Western Bay of Plenty District Council. In fact, we’ve been representing Bay of Plenty Regional Council and Western Bay of Plenty District Council for more than 20 years.
Our prosecution and enforcement work for Bay of Plenty Regional Council has included more than 80 prosecutions under the Resource Management Act 1991 for different offences, and a number of enforcement order applications and abatement notice appeals. It’s also included enforcement work relating to the Regional Council’s Navigation Safety Bylaw and drafting of that Bylaw.
Our regulatory prosecution and enforcement work for Western Bay of Plenty Council has included Resource Management Act, Building Act and Dog Control Act cases.
We’ve acted for both Tauranga City Council and Whakatane District Council in recent Resource Management Act prosecutions and enforcement order applications and conduct Building Act prosecutions for both councils.
Other regulatory work for local authorities includes conducting Dog Control Act prosecutions and appeals, advising on Building Act and Resource Management Act enforcement and advising on Traffic Bylaw enforcement.
The majority of the local authority prosecution and enforcement work is undertaken by Adam Hopkinson and solicitors Victoria Brewer and Mallory Schofield. Other members of the litigation team also have involvement in enforcement work.
